Applications are invited from suitably qualified international students for the PhD Research Position (Faculty of Law and Criminology) at Ghent University for the 2023/2024 session. This program is eligible for PhD candidates.
This PhD Research Position is an opportunity with 100% Occupancy rate for qualified international PhD students. This program is hosted by Ghent University, Belgium. The PhD researcher will be based at the Faculty of Law and Criminology at Ghent University, and will be also part of the interfaculty Metamedica Platform. The PhD student will be investigating the rights of the individuals in the context of secondary uses of health data for research purposes in the view of the applicable regulatory frameworks.
Ghent University is a public research university located in Ghent, Belgium. Established before the state of Belgium itself, the university was founded by the Dutch King William I in 1817, when the region was incorporated into the United Kingdom of the Netherlands after the fall of First French Empire. In that same year, he founded two other universities for the southern provinces as well, alongside Ghent University: University of Liège and State University of Leuven. After the Belgian revolution of 1830, the newly formed Belgian state began to administer Ghent University. In 1930, UGent became the first Dutch-speaking university in Belgium. Previously, French (and, even earlier, Latin) had been the standard academic language in what was Université de Gand. Located in Flanders, Ghent is one of the largest Belgian universities, consisting of 44,000 students and 9,000 staff members. The university also supports the Ghent University Library (including the famous Boekentoren) and the Ghent University Hospital, which is one of the biggest hospitals in Belgium.

The PhD student will be investigating the rights of the individuals in the context of secondary uses of health data for research purposes in the view of the applicable regulatory frameworks.
In particular, the PhD researcher should identify and assess the relevant provisions in applicable regulatory frameworks in the EU, including the GDPR, upcoming Data Governance Act and the European Health Data Space, which can strengthen the rights of the individuals when their data are being processed for research purposes.
This legal analysis should be based on the relevant theoretical framework on the principles of transparency, fairness and lawfulness in processing of health data.

Requirement and Eligibility Criteria for PhD Research Position (Faculty of Law and Criminology) 2023:
- You have a master degree in Law or a relevant discipline
- You have a passion for research and strong analytical skills.
- You are willing to familiarize yourself with interdisciplinary methodologies in health privacy research and follow literature in bioethics, health and data protection law, and health informatics.
- You have an impressive track record (study results, publications and/or awards)
- You are able to work independently and take initiative, yet you are also a team player.
- You have high organizational skills, and able to meet the deadlines.
- You have excellent written and oral communication skills in English.
- Existing educational, research or professional background in EU data protection law and/or health law will be an asset for this position.
